Our Services - Food and Beverage

1. Designing Dynamic Agreements. We construct and negotiate a wide range of concise and clear beverage industry agreements, including importation, DSP, wholesaling, distilling, brewing, and licensing.

2. Complying with Regulations. We help new and established, foreign and domestic beverage producers and distributors to comply with federal regulations applicable to the production, distribution, advertising, taxation and sales of beer, wine and spirits.

3. Designing Compliant Labels. We help clients design food and beverage labels that have a better chance of getting approved by government entities. We apply our experience to speed our clients through the Certificates of Label Approval (“COLA”) process.

4. Providing Formula Direction. We assist clients to formulate beverages to get tax and label advantages, to comply with relevant laws and regulations, and to get those formulas approved by the TTB rapidly and favorably. Our experience in formula-related processes ranges from lab reports, pre-import approvals, statements of process, PFAP, and Flavor Ingredient Data Sheets.

Lehrman Beverage Law is Of Counsel to The Jorgensen Law Firm on food and beverage issues. Its founder and principal, Robert C. Lehrman, has more than 20 years of experience in successfully representing wineries, breweries, distilleries and importers on ATF, TTB, FDA and Customs matters. He has taken scores of alcohol beverage companies from incorporation to licensing to formulation to labeling to marketing. Robert has also managed several large-scale product recalls, helped win a false advertising case, and successfully petitioned to change various federal regulations.

Robert graduated from the State University of New York at Buffalo Law School and received his undergraduate degree from St. Lawrence University in Canton, New York. He is admitted to practice in Virginia, Pennsylvania, and Washington, D.C. He founded his firm in 2001 after 12 years at a Washington, DC law firm specializing in federal and state administrative law.
